These Terms of Service (the "Terms") are a binding agreement between you and RealtyPrep. They govern your access to and use of the RealtyPrep website, applications, content, and services (together, the "Service"). By creating an account, purchasing a plan, or otherwise using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.
RealtyPrep ("RealtyPrep", "we", "us", or "our") provides an online study platform for the British Columbia real estate trading services licensing exam. RealtyPrep is an independent educational study aid. We are not affiliated with, endorsed by, sponsored by, or connected to the University of British Columbia, the UBC Sauder School of Business, the Real Estate Division, the BC Financial Services Authority (BCFSA), or any government body or regulator. Enrollment in the official UBC Sauder licensing course, and licensing by BCFSA, are separate requirements that you must complete on your own. RealtyPrep does not administer, influence, or have any role in the official course or exam.
You must be at least the age of majority in your province or territory of residence (19 in British Columbia) and able to form a binding contract to use the Service. If you use the Service on behalf of another person or an organization, you represent that you are authorized to accept these Terms for them.
All content on the Service, including lessons, notes, practice questions, calculators, and responses from the AI tutor, is provided for general educational and exam-preparation purposes only. It is not legal, financial, tax, or professional advice, and it does not create any professional or advisory relationship. Practice questions and mock exams are our own original, exam-style material; they are not real, past, or official exam questions, and we do not claim any specific pass rate. Laws, regulations, forms, and exam content change, and our material may contain errors or become out of date. You are responsible for verifying anything important against the official course materials, BCFSA, and, where a real-world legal or financial situation is involved, a qualified professional. You rely on the Service at your own risk.
The AI tutor generates responses automatically using third-party artificial-intelligence models. It can be wrong, incomplete, or misleading, and it is not a substitute for the official course, a licensed professional, or your own judgment. Do not submit confidential, sensitive, or personal information about yourself or others to the AI tutor. We may set reasonable usage limits and may suspend access if the feature is misused or used in a way that imposes excessive cost.
You must provide accurate, current, and complete information when you create an account and keep it updated. You are responsible for safeguarding your login credentials and for all activity under your account. Accounts are personal, for a single individual, and non-transferable. Sharing, reselling, or providing access to your account, or creating an account with false information, is grounds for suspension or termination without refund. Notify us promptly of any unauthorized use.
Except as required by applicable law or as expressly provided by the pass guarantee in Section 8, all payments are final and non-refundable, including partial subscription periods after cancellation. See our Refund Policy for details.
Eligible plans include a pass-or-refund guarantee: if you meet every condition in this Section 8 and do not pass the BC real estate trading services licensing exam, we will refund 100% of the amount you actually paid RealtyPrep for the eligible plan. This guarantee is a limited contractual promise on the terms below; it is not a warranty or a prediction that you will pass.

The Service and all of its content, including lessons, questions, explanations, notes, templates, graphics, software, and the RealtyPrep name and branding, are owned by us or our licensors and are protected by copyright, trademark, and other laws. Subject to these Terms and your payment of applicable fees, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access and use the content solely for your own exam preparation. You may not copy, reproduce, distribute, publish, publicly display, sell, sublicense, rent, scrape, data-mine, use to train any machine-learning or AI system, or create derivative works from any part of the Service, except as expressly permitted. All rights not expressly granted are reserved.
When you submit content through the Service (for example, contact messages, support requests, or AI tutor prompts), you grant us a worldwide, royalty-free licence to use, store, and process that content to operate, secure, and improve the Service and to respond to you. If you send us feedback or suggestions, you grant us the right to use them without restriction or obligation to you. You are responsible for the content you submit and confirm you have the right to submit it.

The Service relies on third-party providers (for example, hosting, database and authentication, payment processing, email delivery, AI models, and analytics or advertising platforms) and may link to third-party sites. We are not responsible for third-party services or content, and your use of them is governed by their own terms and privacy policies.
We may modify, suspend, or discontinue any part of the Service at any time, and we do not guarantee that the Service will be uninterrupted, error-free, secure, or available at any particular time. We may impose limits on certain features or restrict access without liability.
To the maximum extent permitted by applicable law, the Service and all content are provided "as is" and "as available", without warranties or conditions of any kind, whether express, implied, statutory, or otherwise, including any implied warranties or conditions of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that using the Service will cause you to pass any exam, obtain any licence, or achieve any particular result, except for the specific contractual promise in the pass guarantee (Section 8). Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.
To the maximum extent permitted by applicable law, RealtyPrep and its owners, employees, contractors, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, study time, examination fees, or business opportunities, arising out of or relating to the Service or these Terms, whether based in contract, tort (including negligence), or any other theory, even if we have been advised of the possibility of such damages. Our total aggregate liability for all claims arising out of or relating to the Service or these Terms will not exceed the greater of the amount you actually paid us in the 12 months before the event giving rise to the claim, or CAD 50. Some jurisdictions do not allow certain limitations, so some of these limits may not apply to you; in that case our liability is limited to the smallest amount permitted by law.
You agree to indemnify, defend, and hold harmless RealtyPrep and its owners, employees, and contractors from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or connected with your use of the Service, your content, your violation of these Terms, or your violation of any law or the rights of any third party.
You may stop using the Service at any time and may cancel a subscription from your account settings. We may suspend or terminate your access at any time, with or without notice, if you breach these Terms, if we suspect fraud or misuse, or as needed to protect the Service or other users. On termination, your right to use the Service ends. Sections that by their nature should survive (including Sections 3, 7 to 11 and 14 to 19) will survive termination.
These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada that apply there, without regard to conflict-of-laws rules. Before starting any formal proceeding, you agree to first contact us at support@realtyprep.ca and try in good faith to resolve the dispute informally for at least 30 days. Any dispute not resolved informally will be subject to the exclusive jurisdiction of the courts located in British Columbia, and you consent to that jurisdiction and venue, except where applicable consumer-protection law gives you a right you cannot waive. To the extent permitted by law, any dispute will be resolved on an individual basis, and you waive any right to participate in a class or representative proceeding.
We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date and, where appropriate, notify you by email or in-app. Changes take effect when posted unless stated otherwise. Your continued use of the Service after changes take effect means you accept the updated Terms.
These Terms, together with the Privacy Policy and Refund Policy, are the entire agreement between you and us regarding the Service. If any provision is found unenforceable, the rest remains in effect and the unenforceable provision is limited to the minimum extent necessary. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them to a successor or affiliate. Neither party is liable for delays or failures caused by events beyond its reasonable control.
